DRIVEO Terms of Use (T.o.U)

1. DRIVEO provides an integrated fleet management system and marketplace platform.

1.1 Enables connections between:

1.1.1 DriveoUser

Individuals/companies offering fleet management or transport services.

1.1.2 WAHDAH Customers

Those needing rental vehicle transportation.

1.2 Owned and managed by Wahdah Technologies Sdn Bhd, based in Melaka, Malaysia.

1.2.1 Contact: operation@wahdah.my. 

2. Amendments to the Agreement

2.1 Terms form a legally binding covenant between DRIVEO and DriveoUsers.

2.2 DRIVEO reserves the right to amend these Terms without prior notice.

2.3 Amendments take effect immediately upon publication.

2.4 Continued use of the Platform signifies acceptance of the revised Terms.

3. Eligibility

3.1 Open to individuals/companies owning or having ownership or custody of vehicles.

3.2 DriveoUsers must:

3.2.1 Meet all legal requirements.

3.2.2 Have the authority to comply with the Agreement personally or on behalf of an entity.

4. Terms of Use

4.1 Account Requirements

4.1.1 Create an account with valid personal and banking/credit card details.

4.1.2 Install Telegram for communication with DRIVEO representatives.

4.2 Account Security

4.2.1 Sharing IDs, passwords, or account access is prohibited.

4.2.2 DRIVEO is not liable for breaches caused by DriveoUser negligence.

4.3 Platform Accessibility

4.3.1 Requires electronic devices (desktop, laptop, smartphone, tablet) and internet access.

4.3.2 Available on web, android, and iOS.

4.3.2 DRIVEO strives to ensure availability but isn’t liable for disruptions.

4.4 Registration

4.4.1 The platform is free to use upon successful registration.

4.4.2 Misrepresentation leads to immediate access denial.

4.4.3 DRIVEO reserves the right to refuse/terminate accounts for any reason.

5. Intellectual Property (IP)

5.1 Ownership

5.1.1 DRIVEO retains all IP rights to the Platform (databases, designs, trademarks, etc.).

5.1.2 Submissions provided by DriveoUsers become DRIVEO’s property.

5.2 Prohibitions

5.2.1 Creating materials resembling DRIVEO Trademarks without approval.

5.2.2 Using DRIVEO Trademarks in unlawful or unauthorized activities.

5.2.3 Uploading copyrighted content without prior permission.

6. Restrictions on Activity

Prohibited activities include:

6.1 Violating local, national, or international laws.

6.2 Introducing harmful programs, viruses, or files.

6.3 Compromising Platform integrity (e.g., reverse engineering).

7. Disclaimers

Services are offered "as is" without guarantees on:

7.1 Quality, accuracy, relevance, or suitability.

7.2 Availability, uninterrupted operation, or error correction.

8. Communications with DRIVEO

8.1 DriveoUsers consent to receive communication via:

8.1.1 Emails, text messages, phone calls, push notifications.

8.1.2 Platforms like Telegram and WhatsApp.

8.2 Communications may include automated systems.

9. Indemnity

DriveoUsers agree to indemnify DRIVEO (and its affiliates, officers, etc.) for:

9.1 Breaches of this Agreement.

9.2 Violations of laws or third-party rights.

9.3 DRIVEO’s negligence in certain cases.

10. Liability

DRIVEO is not liable for:

10.1 Incidental, punitive, or consequential damages.

10.2 Data loss or corruption on the Platform.

11. Severability

Invalid provisions do not affect the validity of remaining Terms.

12. Waiver

DRIVEO’s failure to enforce rights does not constitute a waiver.

13. Relationship with DRIVEO

13.1 Relationship defined as:

13.1.1 Independent contractor status.

13.1.2 No employment, joint venture, franchise, or agency relationship.

13.2 No entitlement to employee benefits (e.g., leave, insurance, bonuses).

14. Warranty and Representation

DriveoUsers guarantee compliance with:

14.1 Copyright, trademark, and anti-spam laws.

14.2 Usage only for authorized and legal purposes.

15. Obligations in Dispute Resolution

15.1 DRIVEO may use DriveoUser information for:

15.1.1 Investigating disputes or legal matters.

15.1.2 Compliance with laws, court orders, or regulatory bodies.

15.2 Ensures confidentiality and safeguards against unwarranted disclosure.
